1. Scope of Application

 


These General Terms and Conditions apply to all orders placed in the FellRebell online shop, accessible at https://www.fellrebell.atAttachment.png.

The version of the Terms and Conditions valid at the time of the order shall apply.

 


 

 

2. Contracting Party and Contract Language

 


The purchase contract is concluded with Nadja Stadler (Fell Rebell), Bandgasse 28, 1, 1170 Vienna, Austria, [sumiundstitch@gmail.com], at the time the goods are dispatched.

The contract language is German.

 


 

 

3. Conclusion of the Contract in the Online Shop

 


The presentation of goods in the online shop (https://www.fellrebell.atAttachment.png) does not constitute a legally binding offer. It is merely an invitation for you to make an offer.

You submit a binding offer by completing your order in the FellRebell online shop via the “Buy now” button.

Before submitting the order, you can review and correct your address information and the contents of your shopping cart. You may also cancel the order process at any time by closing the browser window.


After submitting your order, you will receive a confirmation email (acknowledgment of receipt). This does not yet constitute acceptance of the contract.

Acceptance of your offer occurs either through the dispatch of the goods or the immediate payment of the goods following completion of the order — whichever occurs first.


We only deliver in standard household quantities and exclusively to end consumers. Deliveries to commercial resellers are excluded.

 


 

 

4. Right of Withdrawal (Right of Cancellation)

 


In Austria, the term “right of withdrawal” corresponds to the German “Widerrufsrecht.” The two are used interchangeably below.


 

4.1 Right of Withdrawal

 

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party named by you (who is not the carrier), have taken possession of the goods.


 

4.2 Exercising the Right of Withdrawal

 

To exercise your right of withdrawal, you must inform us (Nadja Stadler, Fell Rebell, Brandgasse 28, Door 1, 1170 Vienna, Austria, [your contact details]) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract.

You will receive an email confirming receipt of your withdrawal within two calendar days.


 

4.3 Consequences of Withdrawal

 

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for any additional costs incurred if you chose a delivery method other than the standard delivery offered by us).

We may withhold reimbursement until we have received the goods back.


Reimbursement will be made using the same payment method you used for the original transaction unless expressly agreed otherwise.


The goods must be returned without undue delay and in any event no later than 14 days from the day you notify us of your withdrawal. You bear the direct cost of returning the goods. The return costs are estimated at a maximum of approximately €7.00.


You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.


 

4.4 Exceptions to the Right of Withdrawal

 

There is no right of withdrawal for:

 

  • Goods made to customer specifications or clearly tailored to personal needs.

  • Goods delivered sealed that are not suitable for return for health protection or hygiene reasons once unsealed.

  • Goods that may perish quickly or have a short expiration date.

 

 


 

 

5. Prices and Shipping Costs

 


All prices are total prices, including all taxes and duties, but excluding shipping costs.

Our sales prices are subject to a flat-rate shipping charge of €4.30 per order within Austria and €6.50 per order within Germany.

Shipping costs are displayed separately during the ordering process.

 


 

 

6. Delivery

 


We ship ordered products to the delivery address specified during checkout.

We currently deliver only to addresses in Austria and Germany.

Delivery time is usually 3–5 working days and begins once your payment has been made.

7. Payment Terms

 


We accept the following payment methods/credit cards:

American Express, Apple Pay, Bancontact, EPS, Google Pay, iDEAL, Klarna, Maestro, Mastercard, PayPal, Shop Pay, Union Pay, and Visa.


For instant payment methods, you agree to pay the full purchase price immediately upon placing the order.


Even in the event of a non-culpable payment delay, we are entitled to charge default interest of 4% per year.

Claims for higher proven damages due to default remain unaffected.

 


 

 

8. Retention of Title

 


The goods remain our property until full payment has been received.

In the event of delayed payment, we reserve the right to enforce our ownership rights.

The exercise of the retention of title does not constitute a withdrawal from the contract unless explicitly stated otherwise.

 


 

 

9. Warranty

 


The statutory warranty provisions apply.

The warranty period for the delivery of movable goods is two years from receipt of the goods.

Claims based on statutory warranty rights or other complaints may be submitted using the contact details provided in the legal notice (Impressum).

No additional guarantees beyond the statutory warranty are provided.

 


 

 

10. Liability

 


We are liable only for intent and gross negligence, as well as under the provisions of the Austrian Product Liability Act.

 


 

 

11. Final Provisions

 


Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The applicability of mandatory provisions of the country in which you have your habitual residence at the time of the conclusion of the contract remains unaffected.
